These terms and conditions ("Terms") apply when you order or buy goods on the website. Trade conditions can be updated from time to time (for example, to reflect changes in technology, our business model, our system capacity or in relevant laws and regulations) and therefore we ask you to approve the conditions every time you shop with us. Any reference to “you” or “your” means you as a user of the website, one-every reference to “we”, “us” or “our” means Exercere ApS.

If you do not agree to the terms, you cannot order or purchase items on the website.

You have the right to resign from this agreement without justification within 14 days of the day where you or a third party specified by you, however, not the carrier, gets the goods in physical possession. Read more under "Right of Rights".

The deficiency rules of the Purchase Act apply to your purchase, which means that you have certain law-determined guarantees of the contractuality of the goods. Read more under "Failed Goods and Incorrect Goods".


Order

The online store is open 24 hours a day, but may be closed as a result of maintenance. We try as far as possible to perform such maintenance during the night hours.

An order placed on a public free or holiday will be processed the following weekday.

You must be at least 18 years old to buy goods on the website as well as possess a valid credit card accepted by us. If you are under 18 years of age, you must have a legal basis for entering into an agreement with us.

We can only complete your order if the delivery address is a private address or business address in one of the countries on the list of the "Delivery" page. We do not deliver to post boxes.

We reserve the right to cancel the purchase agreement in one of the following situations, without being responsible for compensation or other costs:

  • Your payment information is not correct or cannot be verified
  • Your order is placed for the purpose of committing fraud, etc. or handed in in connection with a criminal offense or other illegal activity
  • An unintended error occurs on the website, such as a payment error or the like.
  • We have reason to believe that you are under 18 years old


Agreements can only be concluded through the website. We do not process orders made in emails, letters or fax.


At what point in the ordering process are you bound by your order?

Before submitting the order, you have the option of changing the information that you have entered, including delivery and invoice information or payment information. You also have the option of changing the goods or removing items from your shopping cart.

When you click "Buy and Pay", a receipt will appear on your screen. From that time you are bound by the purchase agreement. Please read more under the "right of withdrawal".

Access to the agreement

You will receive via email a confirmation of the content of the agreement. We store agreements, including the order confirmation, for a certain amount of time, and we recommend that you also save these documents as they will not necessarily be available on the website subsequently. Delivery Terms

Items will be delivered at the delivery address or nearest parcel shop specified when ordering. We only deliver to private and corporate addresses - not for post boxes.

Your item will, as a starting point, be delivered during the weekdays Monday to Friday. The timing of delivery depends on which country the delivery takes place and which carrier is used.

The goods must be acknowledged at the receipt unless you make another agreement directly with the carrier. It doesn't necessarily have to be you who acknowledge. People at the delivery address (eg a family member, a friend, receptionist, etc.) can thus acknowledge the reception with binding effect for you.

Please note that you carry the risk of the item after delivery. If the packaging appears to be damaged, you should refuse to receive the item. If you would like to complain about any errors and deficiencies, you must inform us of it, read more under "Failed goods and incorrect items".


Separate deliveries

If your order consists of several goods, we reserve the right to make separate deliveries. Separate deliveries may be necessary if certain items are delayed or not in stock at the time of order. You will be informed that your order is subject to separate deliveries. You will not be charged additional delivery costs for separate deliveries.


Follow your order and see history

Once you have placed your order you will receive a confirmation email. Here you will find a link where you can follow your order and see the history. The carrier will also send you information about delivery by mail and/or sms.

If you do not receive the confirmation email or have trouble following the order, you can contact Customer Service who will do their best to give you information about the status of your order.


Right of withdrawal (applies only to consumers)

You have the right to resign from this agreement without justification within 14 days.

The cancellation deadline expires 14 age after the day you or one of you stated third-man, however, not the carrier, gets the goods in physical possession.

In the event of several different items ordered in one order but is delivered individually (ie separate deliveries), the cancellation deadline expires 14 days after the day you or one of you stated third party, however not the carrier, gets the last item in physical possession.

In the event of a product consisting of multiple parties or parts, the cancellation deadline expires 14 days after the day you or one of you stated a third party, however not the carrier, gets the last party or the last part in physical possession.

To exercise the right of withdrawal, you must notify us (see contact information below) Your decision to cancel this agreement in an unequivocal statement (eg by e-mail or note enclosed with the goods in return shipping).

The cancellation deadline is complied with if you send your notice of the right of withdrawal before the cancellation period has expired.

Follows of regret

If you exercise your right of withdrawal in this agreement, we will refund all payments received from you, including delivery costs (though not additional costs as a result of your own choice of a form of delivery than the cheapest form of standard delivery we offer), without undue delay and In any case, within 14 days of the date we received notification of your decision to cancel this Agreement. We make such a refund with the same means of payment that you used in the original transaction, unless you have explicitly agreed in something else. In any case, you are not charged with no types of fees as a result of the repayment.

We can withhold the refund until we have received the goods returned or you have provided documentation of having returned the goods, whichever is earlier.

We incur the costs associated with the return of the goods.

You must return the goods without undue delay and within 14 days of the date you have informed us of the exercise of the right of withdrawal. The deadline is complied with if you return the goods before the expiry of the 14 days.

We recommend that you save the post receipt as proof that you have handed in the package to the mail/carrier.

You are only liable for any deterioration in the value of the goods caused by handling other than what is needed to determine the nature, properties of the goods and the way they work.

Defective goods and incorrect items

If your item is suffering from a defect or we have delivered incorrect items please contact our customer service. Can you already see the defect, etc. At the time the carrier wants to make delivery, you should refuse to receive the item.

In case of a defective item or incorrect item, you can choose from the following options:

  • Return the item and get refunded the purchase price and all delivery costs when our customer service has processed the return goods,
  • Return the item and receive a similar item when our customer service has processed the return item provided we can deliver a similar item, or
  • Retain the item and request a proportionate reduction of the purchase price

When you contact Customer Service, you must provide the order number, possibly the item number, and describe what is wrong with the item, etc.

You are not responsible for costs associated with the return of a defective item or an incorrect item. Of course, we will repay the purchase price and the original delivery costs when we have received the item, unless you get a new item to replace the raised item.

OTHER CONDITIONS

Updating the website

We do our best to update the website as well as ensure that prices, offers, descriptions and other information about the goods are correct. However, spelling errors, errors in prices, offers, descriptions and other information about the goods can occur, and sometimes we discover that the price of an item is stated incorrectly.

Force Majeure

By accepting these terms, you consent to such a future transfer. At the same time, you agree that from the time we have notified you of the transfer, DI-NE RIGHTS can only be claimed to the third party concerned.

We process your personal information confidentially. Please read our Privacy Policy, which talks about how we use the personal information that you provide to us in connection with the post-positioning procedure and your use of the website in general.


Law selection and venue

Any agreement concluded between us using these conditions is subject to Danish law. Any dispute that may arise in connection with our agreement, including the existence or validity of the agreement, must be brought before a competent court in Denmark.
